What are trademarks?

Trademarks are a word, illustration or symbol that helps us identify the source of the product or the source of the service. In other words: these are words and symbols that help us quickly and easily identify a particular commodity created by a particular manufacturer. A good example are cars or sneakers - it is enough for us to identify what the symbol imprinted on the shoe or vehicle to know who is the manufacturer.

The legal definition of trademarks is broad: "letters, numbers, words, figures or other signs or their combination, in two or three dimensions; used, or intended to be used, by a person for the purpose of the goods he produces or trades in." In practice, most of the trademarks to which we are exposed on a daily basis are logos, trademarks and recognizable names of businesses (brands).

To protect the name of the business, its logo and product names, in most cases, it is necessary to register the trademark with the Registrar of Trademarks at the Ministry of Justice. The registration provides the right to use the mark exclusively and prevents others from using the registered mark or similar marks to the point of deception. This situation allows the owner to invest in creating the reputation of the business, product or service and differentiate itself from competitors without fear.

In case a third party uses the registered trademark without permission, a temporary, and later permanent, restraining order may be sought to stop the infringement. In addition, destruction of infringing products and monetary compensation can be claimed.
